RAW MILK PRODUCTS BILL
The bill passed the ND House of Representatives on a vote of 82-9 on January 24th. You read the text of the bill, read testimony submitted to the House Ag Committee and watch related videos here.
The bill now moves to the Senate Ag Committee for a hearing. Because that committee has to deal with the Senate bills first, we anticipate there won't be a hearing until February 15th or later. We'll post the information when it becomes available.
When the direct to consumer sales of raw milk bill was passed in 2023, the language exempted producers from all processing laws and rules. We believed we could also sell products made from raw milk, as long as they were sold to the consumer and not through stores or third parties.
The ND Department of Agriculture disagreed and sent warning letters to raw milk producers, threatening action if we sold any products other than milk. No cream, yogurt, cheese, etc.
The purpose of HB 1131 is to clarify that producers can also sell products they make from farm fresh milk. You can follow all the action on this legislation here.
We encourage you to follow the legislation, submit testimony, and contact your legislators to ask them to support direct to consumer sales of raw milk products without government regulation.
